BOOKING TERMS & CONDITIONS
PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP WITH SISTERS AND SUITCASES. THIS IS A LEGALLY BINDING AGREEMENT
The following terms and conditions apply to any trip or service (hereinafter referred to as “Product”) booked with Sisters and Suitcases (hereinafter referred to as “Company” “SAS” “our” “us”). By booking a trip with Sisters and Suitcases you (hereinafter referred to as, “Client(s)” “guest” “customer” “you” “your” or “traveler(s)” “experiencer”) acknowledge that you (i) are 21 years of age or older, (ii) understand and accept these terms and conditions (the “Terms and Conditions”) and (iii) are entering into a contractual relationship with Sisters and Suitcases.
Sisters and Suitcases travel itineraries (“Experiences”) are governed by the following Terms & Conditions (“Terms”). By booking an Experience and placing a deposit, you acknowledge and agree to these Terms.
Client agrees to release, indemnify, and hold harmless Sisters and Suitcases, its officers, directors, employees, contractors, vendors, travel guides, assignees, transferees, agents, and any other third parties acting on Sisters and Suitcases behalf against any and all expenses, losses, damages, accidents, injuries, claims, or deaths resulting in whole or in part, either directly or indirectly, from any aspect of travel and/or activities facilitated by Sisters and Suitcases. The Client further agrees that in no event and under no circumstances shall Sisters and Suitcases, nor its officers, directors, employees, vendors, guides, contractors, assignees, transferees, agents, and other third parties acting on the Company's behalf bear any total or aggregate liability (either jointly or severally) under Agreement that exceeds the amount of total fees paid by Client to Sisters and Suitcases for the particular trip in question.
The Client agrees to abide by all applicable domestic and international laws and regulations in the countries of travel and residency, regardless of length of time in said countries. If questioning, apprehension/arrest, detainment, punishment, or incarceration by lawful authorities occurs, Sisters and Suitcases shall not be responsible or liable, either legally, financially or otherwise, for Client actions or release.
1. RELEASE & ASSUMPTION OF RISK
We want you to know that there are some unavoidable risks associated with travel. We pride ourselves on the places we visit, our partners, and the Experiences we’ve created for you. But, you recognize that international travel may be unpredictable, and that our responsibilities are limited as discussed in these Terms.
Experiences take place in destinations outside of the United States. Although we scout each location; partner with awesome, knowledgeable partners; and take appropriate care in curating each Experience; we cannot guarantee any less risk than you might experience on your own. That means that, while we cannot guarantee your safety or your belongings, we promise to be upfront with you about where we’re planning on going and who we partner with. And, we promise to be available in a meaningful way should you need us. But, we expect and you agree that you will use proper care and be responsible for your well-being.
In booking an Experience and paying a deposit, you acknowledge that Experiences may:
These Terms are a release and assumption of risk for you, your family or heirs, and any executors and administrators. The Terms are in addition to any additional releases, waivers, limitations of liability, or assumptions of risk that you may sign.
2. INSURANCE
It is mandatory that all Sisters and Suitcases travelers provide proof of current travel insurance before the trip begins. Travel insurance must cover personal injury, medical treatment, repatriation, and evacuation expenses, including helicopter rescue and air ambulance internationally. It is recommended that travel insurance also address personal property and trip cancellation coverage.
Trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses should a Sisters and Suitcases trip be canceled, postponed, interrupted, rescheduled, for any reason, whether voluntarily by you or as a result of Sisters and Suitcases’s actions. You are responsible for understanding the specifics of your travel insurance policy, ensuring that your policy covers all optional and included activities listed in the trip itinerary, and ensuring that there are no exclusion clauses (e.g., air delays due to mechanical issues) that would limit the coverage that you might reasonably need. If you have current health insurance coverage, check your insurance policy to see if it provides the coverage described above while traveling outside your country. It is your responsibility to verify your insurance policy details with your insurance provider to ensure Sisters and Suitcases’s requirements are satisfied.
You agree to assume all costs of medical care and transportation that is provided to you, and any minors traveling with you, during the trip. Please note that most companies offering travel insurance require the policy to be purchased within 14 days of the initial trip deposit or payment to any service provider in order to cover pre-existing conditions or to provide for “cancel for any reason” coverage.
3. HEALTH & MEDICAL
Medical care is different around the world. Sometimes, getting prompt attention abroad is more challenging than it may be at your home. We will do our best to assist in the event of any medical issue, but we are relying on you to let us know of potential issues and, should you have an issue, you agree that we are not responsible. Because of the costs of medical care, we require all of our travelers to obtain travel medical insurance.
Experiences take place in countries outside of the United States. Medical care and access to medical care may be different from what you are accustomed to. If you have any conditions or disabilities that we should be informed of, please let us know in advance so that we can help you obtain appropriate accommodations or take appropriate steps in case of need.
In booking an Experience, you acknowledge that Experiences may:
Some of our experiences may require a certain level of fitness. In booking an experience and placing a deposit, you state that you:
Sisters and Suitcases reserves the right to refuse or cancel any booking in the event of a medical condition that would make your participation a hazard for you or others, or for any other legal reason.
Sisters and Suitcases strongly recommends that you check with the U.S. Centers for Disease Control and Prevention, or similar entity in your country, for up-to-date, destination-specific information related to food and water safety, infectious diseases, and other concerns. At your own cost and expense, you will meet with your doctor at least 8 weeks prior to your trip departure and obtain any and all vaccinations, inoculations, or prescribed medications as directed by your doctor and/or travel clinic for the areas visited, and provide written documentation thereof upon request and as needed for travel documentation.
Our suppliers reserve the right to conduct health screenings (e.g., temperature checks, questionnaires, and checks for observable signs and symptoms) and refuse travel to participants deemed symptomatic or likely symptomatic. If necessary, suppliers and/or government or health authorities also reserve the right to quarantine travelers with symptoms of infectious diseases aboard confined modes of transport such as ships, trains, etc.
Sisters and Suitcases does not tolerate drug use of any kind during our trips and strongly encourages responsible alcohol consumption. This policy is in place for your safety and those traveling with you. Sisters and Suitcases reserves the right, at your sole expense, to deny participation in an activity or in the remainder of any trip itinerary if you illegally use drugs, alcohol or other banned substances during a trip. We want you to have fun and encourage you to take advantage of the local culture, but Sisters and Suitcases emphasizes safety as a top priority.
4. Deposits, Payments, Refunds and Cancellations
Prompt payment is important not only to us, but also to our partners. Timely payment by our travelers allows us to reserve the best lodgings and ensure our partners are available for each Experience. Full payment must be made at least sixty days before your Experience’s start date.
Bookings may be made through our online booking system or through an authorized travel agent. You are required to pay a non-refundable deposit or first payment for your booking to be confirmed, non-refundable monthly payments if a payment plan option is selected and a non-refundable final payment of the entire balance due no later than 60 days before the trip departure date, unless otherwise stated in the Special Conditions or on the itinerary page on our website for a specific trip. For bookings made 60 days or sooner before the trip departure date, the entire trip cost must be paid when the booking is confirmed and is non-refundable. Review the applicable deposit and payment schedules carefully. Note that a booking is not accepted and there is no contract between us until we confirm your booking in writing.
The following are specifically excluded from the trip rates and are the sole responsibility of each Traveler: Airfare; travel insurance; costs of obtaining passports; visas; excess baggage charges; gratuity/tips; items of purely personal nature; such as drinks; laundry; Covid-related expenses (whether mandatory or voluntary) such as testing, quarantine, etc., communication (calls, faxes, emails etc.); international airport departure tax (to be paid in US dollars or acceptable foreign currencies); excursions or deviations from any trip itinerary. We will not be responsible or liable for deposits, payments, policies or penalties for other services not included, such as airline tickets, separate hotel reservations, or other items handled by you and not through us.
Credit Card Payment/Processing: Sisters and Suitcases uses a third-party credit card processing company to provide clients with a convenient way of submitting payment. Sisters and Suitcases is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of Products and will not refund or return any fees charged by such third parties in connection with payments made by Clients to Sisters and Suitcases.
Credit/Debit Card Chargeback Policy & Payment Disputes. We work hard to make our customers happy. If you are not pleased with our services for any reason, you agree not to file a chargeback with your credit or debit card company either directly or through someone else, including a travel agent, before you have given us an opportunity to address the matter. You agree to work with us and any travel agent acting on your behalf in good faith to resolve your dispute and acknowledge that chargebacks are not an appropriate way to avoid our cancellation and refund policies.
Client agrees to not file a payment dispute or chargeback through their bank/financial institution and to instead utilize travel insurance in the event that she can no longer attend the scheduled trip.
Client agrees to not file a chargeback in violation of Sisters and Suitcases Refund Policy. In the event that a chargeback is requested and/or processed, Client agrees to repay Sisters and Suitcases for the full amount and be responsible for any fees incurred in recouping payment, including attorney’s fees, time, cost and expenses in rebutting the chargeback and pay any damages we suffer as a result of your chargeback dispute.
Late Payment: Failure to make a payment within three days of the agreed upon due date is a breach of contract and will result in a late fee of $100.00.. If payment has not been submitted within seven (7) days of the due date, Sisters and Suitcases reserves the right to cancel Client’s booking and & retain all paid funds.
If Client fails to submit payment in full by 60 days prior to the date of arrival unless otherwise stated in the Special Conditions or on the itinerary page on our website for a specific trip, Sisters and Suitcases reserves the right to cancel booking and retain 100% of funds paid.
Cancellations by You: In the event that a Client attempts to cancel after 14 days of the initial deposit or payment Sisters and Suitcases reserves the right to retain 100% of all paid funds. The Client agrees to not file a dispute or chargeback through their bank and to instead utilize their travel insurance in the event the Client can no longer attend the scheduled trip/event.
Any cancellation of a booking and/or a Product by a Client must be delivered to Sisters and Suitcases in writing by email and be acknowledged by Sisters and Suitcases in writing. Email your cancellation request to [email protected] with your invoice number(s), full name, date of travel and destination. If you do not receive an acknowledgement within 48 hours, please call (501) 960-1226 to ensure your information was received.
Products are NON-REFUNDABLE and NON-TRANSFERABLE between persons. It is highly recommended that Sisters and Suitcases clients PURCHASE trip cancellation coverage. Trip cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your Sisters and Suitcases trip for any reason, whether voluntarily or as a result of Sisters and Suitcase's actions.
Sisters and Suitcases is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the canceled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. To cancel services booked through third party vendors, please contact the applicable vendor.
Cancellation or Changes by Sisters and Suitcases and Flexibility: We reserve the right to cancel, alter or modify any trip without prior notice for any reason, including but not limited to for the safety and/or comfort of clients and for circumstances of Force Majeure, which is defined in this agreement below. This includes the right to replace or substitute guides and accommodations in the trip materials, modify the order in which places are to be visited, reschedule, postpone or delay your trip, and make other changes to the itinerary. You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.
Sisters and Suitcases shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder as a result of any actions that it takes or does not take under this section and under this Agreement.
If we must cancel a trip due to insufficient enrollment for reasons not due to Force Majeure, all trip members will be notified a minimum of 60 days before the trip departs and will have the option to receive a refund of payments made to Sisters and Suitcases less any unrecoverable costs incurred by Sisters and Suitcases or to transfer to a comparably priced replacement trip without penalty.
Any changes may require a supplemental payment from you or result in a partial or full refund. A supplemental payment is a rare situation; however, such a payment may arise due to unexpected events (e.g., increase in government fees). A refund under this section will constitute full settlement of claims you may have arising out of our cancellation.
If Sisters and Suitcases is forced to reschedule, substantially alter, postpone, or cancel your trip for any reason that is completely within its control, whether before or during your trip, we will let you know as soon as possible. In these circumstances, we may offer one or more of the following options within our discretion:
i. Accept Sisters and Suitcases offer of a comparable replacement trip (offered atSisters and Suitcases’s sole discretion and subject to availability),
ii. Receive a refund of all monies paid to Sisters and Suitcases less our Trip Planning Fee of $495, any unrecoverable costs, including but not limited to deposits that we have made to our suppliers and any other out-of-pocket costs that we have incurred in organizing your trip ; or
iii. Any other option that we in our sole discretion believe is a reasonable option.
When accepting an offer for a replacement trip :
i.If the cost is lower than the price of your original trip, you will receive a refund for the difference in cost.
ii. If the cost of the replacement trip is equivalent or higher than your original trip, you will be responsible for the price difference between your original trip and the replacement trip.
If we expressly cancel your trip (versus altering, modifying, postponing, or rescheduling it), we may use reasonable endeavors to reimburse you for any payments that you have made reduced by 1) any and all non-refundable deposits and cancellation fees that we have paid to suppliers and other third parties to provide components of your tour (in many cases it is not possible to obtain refunds from suppliers once we have forwarded deposits for your tour to them), and 2)Sisters and Suitcases $495 per person Trip Planning Fee. In great part for reasons of this nature, we strongly recommend you obtain travel insurance as explained elsewhere in this agreement. Note that if we alter, modify, postpone, or reschedule your tour or offer you a travel credit, such action does not constitute a “cancellation” of your tour by us.
Reinstatement of Reservation: If your travel reservations have been canceled by Sisters and Suitcases, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $200 for international and domestic Sisters and Suitcases Experiences will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services.
Trip Planning Fee: All trip prices include a non-refundable $495.00 Trip Planning Fee per person. Any refunds that we provide to you for any reason will be less than Trip Planning Fee and any other non-recoverable costs, including any monies that we have advanced to our suppliers.
Form of Payment: All payments must be made by credit card. Prices are in US dollars, and all payments must be made in US dollars.
Cancellation Process: To cancel your booking, you must send a written notice to us by email at [email protected]. Cancellation fees will be applied per person according to the schedule set forth in this section, based on the date we receive your written notification, not when you send the email.
5. CHANGES BY YOU PRIOR TO DEPARTURE
Change requests to our itineraries can be very disruptive. If you request to change your trip dates or alter your itinerary after we confirm your booking but before your trip’s departure date, we will consider whether we can reasonably accommodate your request without any disruption to the trip or trip economics. If we are able to make such changes, a change fee may be applied. (There is no change fee for transfers to replacement trips described in the preceding section.) The type and scope of change dictates the amount of the change fee and such fees can be substantial. Our outside suppliers, including hotels, often impose additional fees or penalties for changes and cancellations. Substantial change requests by you, such as for example a change of tour dates, will result in recalculation of your original tour price. Change requests must be made in writing.
It is in our sole discretion whether to accept a change request.
If you decide not to participate in a Program, whether due to governmental warnings or advisories, fear of travel, fear of illness or for any other reason, will be deemed a cancellation by you. In the event you have to cancel the Program because you have contracted Covid-19 (which includes all virus variants directly related to the SARS-COV-2 novel coronavirus, hereinafter referred to as “Covid-19”), test positive for Covid-19, or have been in close proximity to someone who tested positive for Covid-19 fourteen days before trip’s departure prevents you from participating in the Program, Sisters and Suitcases will make best efforts to enable you to reschedule your trip to a later date; however, in the event you are unable to reschedule your trip under such circumstances, the cancellation policy set forth herein will still apply.
6. ALTERATION OR CANCELLATION BY YOU AFTER COMMENCEMENT OF TRAVEL
Change or Cancellation Request
Change requests to our itineraries must be submitted in writing and may result in significant fee increases. To change your booking, you must send a written notice to us by email at [email protected]. For any changes that we are able to accept, change fees will be applied per person according to the terms set forth in these Program Terms & Conditions, based on the date we receive your written notification, not when you send the email.
Upon receipt of your change request, Sisters and Suitcases will forward any alteration that you request after your Program has commenced to our independent suppliers. You will be liable for any cancellation charges and/or change fees that may be imposed for the booking of revised arrangements and for all costs associated with such arrangements. You hereby acknowledge and agree that it is within Sisters and Suitcases sole discretion whether to accept a change request.
You acknowledge and agree that any changes to your booking or cancellation of services at any time, before or during the trip, by you may result in the loss of all monies collected from you and as otherwise described in this agreement. For this reason, we strongly recommend you have comprehensive travel insurance that includes trip cancellation/interruption coverage to help protect your financial investment in the trip. See Section 1 above regarding mandatory insurance requirements.
7. Unused Services
General Reasons: There will be no refund for unused services or unused portion of the trip, early departures, late arrivals, involuntary Program removal, or missed days of your itinerary for any reason.
Unused Portion of Trip (no refunds): There will be no refund for unused services, early departures, late arrivals, or missed days of your itinerary for any reason. There will be no refund once the tour has commenced. Your decision not to participate in the tour due to governmental warnings or advisories, fear of travel, or the like will be deemed a cancellation. Note that if a disruption caused by Covid-19 prevents you from being able to take your trip, we will offer as much flexibility as we can to enable you to reschedule your trip to a later date, although our cancellation policy will still apply should you cancel your trip. Our level of flexibility will be impacted by our suppliers’ policies and practices, which we do not control.
No refunds will be provided to you for any unused portion of your tour, including but not limited to if you are quarantined, a government refuses exit/reentry, or a supplier refuses services if you exhibit symptoms of or test positive for infectious disease. Further, we will not have any liability to you, owe you a refund, or owe you any compensation for loss, damage or injury or anything else if you are infected with an illness, disease or sickness during your tour, or if a third party refuses services (e.g., lodging or transport) if you show symptoms of or test positive for infectious disease. For example, we will not be liable to you if are infected with a virus such as coronavirus at a hotel that we book for you, if you are refused service at a hotel if you show symptoms of a communicable illness such as a cough or fever, if you are unable to board a plane to your destination or return home from your destination because you show symptoms of an illness, you are required to self-quarantine, and so on.
No refunds will be provided for any unused portion of a trip once the trip begins, including but not limited to if you leave a trip for any reason, miss the trip’s departure date or an activity, transportation, last minute changes or have to be removed from a trip. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we highly recommend that you purchase trip cancellation and interruption insurance.
Due to Illness: No refunds will be provided to you for any unused portion of your trip if you are quarantined or a supplier refuses services if you exhibit symptoms of or test positive for an infectious disease. Further, we will not have any liability to you, owe you a refund, or owe you any compensation for loss, damage or injury or anything else if you are infected with an illness, disease or sickness during the Program, or if a third party refuses services (e.g., lodging or transport) if you show symptoms of or test positive for an infectious disease. Solely by way of example and not intended to be exhaustive, we will not be liable to you: if are infected with a virus such as coronavirus at a hotel that we book for you; if you are refused service at a hotel if you show symptoms of a communicable illness such as a cough or fever; if you are unable to board a plane to your destination or return home from your destination because you show symptoms of an illness; or, you are required to self-quarantine, and so on.
8. DENIAL OF PARTICIPATION
Sisters and Suitcases reserves the right to deny participation in the trip to any Traveler that Sisters and Suitcases, in its sole discretion, judges to be incapable of meeting the rigors and requirements of the trip activities, violates these terms including our Code of Conduct, or whose actions or deportment it judges unsuitable for group travel. During the trip, Sisters and Suitcases has the right in its sole discretion to remove anyone who it determines to detract from others’ enjoyment of the trip. The decision of the guide, host or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. Any costs resulting from being removed from a trip or being declined participation in a trip is at your expense.
9. FORCE MAJEURE
Force Majeure. Sisters and Suitcases will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, typhoon, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/Covid-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.
In the uncommon situation where Force Majeure prevents, significantly hinders, or makes it impossible for us or our suppliers to provide the services including but not limited to your tour, we and/or our suppliers shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: cancel, alter, modify, postpone, or reschedule any tour itinerary or arrangement, including tour dates and the entire tour itself. You understand and agree that we will not be able to pay you any compensation, costs, or expenses you incur as a result of Force Majeure. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure, unless and to the extent we are able to obtain any refunds from our suppliers. Any refund under this section will be less than our non-refundable $495.00 trip planning fee per person (“Trip Planning Fee”). Our administration costs in planning your trip are not refundable because of the work involved in planning, booking and management of your trip itinerary from the moment the trip is booked. This “Trip Planning Fee” is a cost that we cannot recuperate, again because of the time and materials already invested in the trip. Please note that we are not obligated to seek refunds from suppliers, and in many instances it is not possible to obtain refunds from suppliers once we have forwarded deposits for your tour to them. Any refund under this section will be less the $495.00 Trip Planning Fee you have paid, and any and all non-refundable deposits and cancellation fees that we have paid to suppliers and other third parties to provide components of your tour. This policy is based on the fact that suppliers, who are typically located outside the United States, are not obligated to return non-refundable deposits or waive their cancellation fees in the case of Force Majeure. For reasons of this nature, we strongly recommend you obtain travel insurance. If you choose to cancel your tour if we invoke Force Majeure, our standard cancellation penalties (see above section titled “Cancellation By You and Unused Services”) will apply unless we expressly state otherwise.
If Sisters and Suitcases is affected by Force Majeure, it, if practicable, will notify you of the nature and extent thereof.
10. SUPPLIERS’ CONDITIONS
Sisters and Suitcases sometimes works with other companies in crafting Experiences. Although we work hard to ensure a safe journey for our travelers, we cannot control those companies we work with and cannot be responsible for their actions.
Sisters and Suitcases acts as an agent for transport companies, hotels and other partners and contractors (“Suppliers”) and is not responsible for any injury, damage, loss, delay or irregularity that may occur when using the products, services, or accommodations of a Supplier, or due to the negligence, recklessness, omission, oversight, inaction, or other fault of a Supplier, including, but not limited to, any defect in a vehicle or any other form of conveying a traveler, acts of God, detention, delays or expenses arising from quarantine, strike, riots, theft, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle or any other form of transport, or in any hotel or guest house, hostel, or other form of accommodation.
The quality of the products, services, and accommodations organized by Sisters and Suitcases are not within the control of Sisters and Suitcases, and the quality of such products, services, and accommodations may be compromised by local conditions. You therefore release Sisters and Suitcases from all claims and causes of action arising from any damage, loss of enjoyment, inconvenience, or injuries related to the quality of such products, accommodations, and services.
Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage. You will be bound by these conditions or conditions. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other Supplier, and they are often also subject to various international conventions. Sisters and Suitcases’ own liability is limited to and shall not exceed that of its Suppliers. You agree that, if you recover for any damages from the Suppliers, you will not seek any recovery for the same damages from Sisters and Suitcases.
11. OPTIONAL ACTIVITIES/FLEXIBILITY
During any Sisters and Suitcases Experiences, there may be opportunities to participate in activities or local events, which are not included in Sisters and Suitcases’s packaged experience. Sisters and Suitcases makes no representations about the safety or quality of these activities and events, or the standard of the independent operator running it. Activities may include, but are not limited to, vehicle/boat/aircraft trips, walking or guided trips, surfing, fishing, hiking, swimming, zip lining, and parasailing. Events may include, but are not limited to, local festivals, concerts, and organized events. You understand and agree that any assistance given by Sisters and Suitcases trip leader or staff to help arrange these optional activities is done in good faith and without any representations or warranties of any kind. Sisters and Suitcases does not sponsor or endorse these activities or events, nor can Sisters and Suitcases be held liable for any injury or illness resulting from your participation. If you decide to participate in these events, you do so voluntarily and should take precautions to ensure your own safety and you will arrange for payment directly with the supplier or independent operators of such activities, events or services
FLEXIBILITY: The Client acknowledges by booking a Product and/or agreeing to travel with Sisters and Suitcases that the nature of this type of travel requires considerable flexibility and acknowledges that they will permit reasonable alterations to the Product and/or itinerary by Sisters and Suitcases. The Client acknowledges their understanding that the route, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the Product will be operated, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Sisters and Suitcases.
12. CLIENT RESPONSIBILITY
The Client acknowledges that depending on the nature of the Product booked, or the location(s) in which such Product is to operate, there may be a significant degree of personal risk involved in travel on the Product. There are dangers inherent to adventure travel generally and Client acknowledges they have considered such risk to health and safety and are willing to assume it, by confirming their booking of such Product. The Client acknowledges she or he has considered the potential risks, dangers and challenges in light of their own personal capabilities and needs, and expressly assumes the risks attendant to travel under such conditions. The Client acknowledges and agrees that Sisters and Suitcases is not responsible for providing information or guidance to the Client with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where Products are operated, and Sisters and Suitcases strongly encourages that Clients locate or make contact with his/her local embassy or consulate in each destination prior to departure on any Sisters and Suitcases Experience.
13. PRE-DEPARTURE DOCUMENTATION
There are a number of documents you will need for each Experience. Some of these are legal requirements, and others are required by Sisters and Suitcases. We can help identify the ones you may need, but ultimately the responsibility for gathering them is yours.
You must have a valid passport and, depending on your place of departure and the destination, a visa, permits, certificates, and proof of vaccination(s). (You will also ensure that your passport will remain valid through all relevant times you are traveling with us.) These requirements are your responsibility. Any information or advice given by Sisters and Suitcases regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory and provided as a courtesy. Sisters and Suitcases is not responsible for any errors or omissions as to any such information provided. Sisters and Suitcases require proof of insurance at least 45 days before the Start Date or one week after the date of booking (whichever is latest). We will work with you to help you identify these documents, but failure to provide these documents may result in cancellation of your booking without refund.
14. PASSPORTS AND VISAS
You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire trip. Valid passports are required for travel to most destinations. Please check with the appropriate consulate or embassy for the latest entry requirements. You assume complete and full responsibility for, and hereby release Sisters and Suitcases from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations. Any information provided to you is merely provided as a courtesy and it is your sole responsibility to ensure you have met all travel requirements for each destination in your itinerary.
Sisters and Suitcases is not responsible for delays, changes, or cancellation costs due to incorrect, incomplete or expired traveler documents. In the event that you must cancel, delay or reschedule your trip due to expired or missing travel documentation, you are responsible for all associated costs to rectify the situation. If you are unable to join your trip, you will not be reimbursed or refunded any amounts as per the cancellation terms listed in this document. We recommend that U.S. citizens register for the U.S. government’s Smart Traveler Enrollment Program, a free service, at https://step.state.gov/step/.
15. BAGGAGE
You are allowed to bring one piece of baggage weighing up to 50 lbs. (23 kg) and one additional medium/small-sized “day pack” on the trip. If you need to bring additional baggage, you are responsible for requesting approval from Sisters and Suitcases before your trip begins. Unless you receive such written approval, your request to bring additional baggage is deemed denied. Sisters and Suitcases is not responsible for and you are solely responsible for securing or protecting your baggage or belongings at any time during any trip.
16. PHOTOGRAPHY AND IMAGE RELEASE
We may hire a photographer to capture special moments from the Experience. You agree that we have your permission to use any such moments in our marketing material or for other related commercial uses.
Sisters and Suitcases may hire a photographer or videographer for the Experience. The Photographer will own the rights to any images, photos, and videos (“Content”) that s/he takes or creates during the Experience. Because the Photographer will own the rights to all Content, you cannot sell any Content or otherwise use it commercially. You may use Content for personal use only. If you post Content, including but not limited to a website or social media, you agree to credit the Photographer by name and a copyright notation.
You agree that Sisters and Suitcases and its agents, suppliers, vendors, and similar third-parties, including Photographers, have a worldwide, royalty-free, perpetual license to use, re-use, distribute, display, create derivative works of, and reproduce any images, photos, or videos (whether directly or through a photo sharing service) in any medium, including but not limited to print, electronic media, or Internet, free of charge and without right to inspection, for any purpose, including to promote and publicize Sisters and Suitcases products and services worldwide.
You also acknowledge and agree that Sisters and Suitcases or other parties, including but not limited to the Photographer and other participants in Your Experience, may during Your Experience take or create images, photos, and videos in any format that contain or feature you. These images may contain your name, likeness, identity, photographic image, videographic image or oral or recorded statements. You agree that Sisters and Suitcases may use these materials for any purpose, including to promote and publicize Sisters and Suitcases products and services, and hereby grant Sisters and Suitcases a perpetual, royalty-free, worldwide, irrevocable license to use such images without prior inspection.
17. LIMITS ON RESPONSIBILITY
Costs associated with travel are your responsibility. We can give you an idea of what some of those costs may be, but we cannot pay them for you.
At no point, and under no circumstance, is Sisters and Suitcase responsible for payments or costs relating to external services such as flights, accommodations, services, car service, or any other part of travel that was booked and paid for externally to Sisters and Suitcases. You are responsible for booking, paying, and arranging for travel to and from the Experience. If Sisters and Suitcases cancels or changes the Experience, it may cause you to incur some change fees or other related costs. Travel insurance may assist you in avoiding any such fees for trip cancellation, interruption, and curtailment.
18. CULTURAL DIFFERENCES, DRUG, & ALCOHOL POLICY
Countries we travel to may have different laws about drinking and drug use than your home country. But, for the sake of our travelers and partners, we require that you act safely and responsibly. Should we determine in our sole discretion that you are endangering yourself or others, we reserve the right to terminate your Experience with no refund.
You acknowledge and understand that traveling abroad may expose you to unique and different situations. These differences may involve cultural and social interactions, such as food, drink, attire, and local laws. While Sisters and Suitcases strives to provide guidance regarding these differences, it is your responsibility to research such differences and act responsibly while traveling.
Sisters and Suitcases does not tolerate drug use of any kind during Experiences and, for our partners and other travelers, requires responsible alcohol consumption. You will comply with the laws of all countries visited. Failure to abide by this provision may result in immediate termination of your Experience by Sisters and Suitcases without a refund or other liability by Sisters and Suitcases.
This policy is for the safety of you, your fellow travelers, and our partners. Sisters and Suitcases wants you to have fun and encourages involvement in local culture, but safety is our top priority.
19. AUTHORITY DURING EXPERIENCES
Sisters and Suitcases has curated each Experience. We are familiar with the partners and the locations. It is of utmost importance that you comply with our requests.
You agree to abide by the authority of the trip leader or other Sisters and Suitcases representatives at all times. Should you fail to do so, or, in the opinion of the trip leader or other Sisters and Suitcases guests, endanger, distress or annoy others, we may immediately terminate your Experience without a refund or other liability.
20. TRAVEL ADVISORIES AND WARNINGS
You must conduct your own research and become informed about the destinations in your trip itinerary, including knowledge about any travel advisories and warnings issued by government authorities in your country. In the U.S., you must consult the U.S. State Department’s website at www.travel.state.gov or contact them by phone at the number specified on their website. You are responsible for protecting your own well-being and personal property before, during, and after your Sisters and Suitcases trip. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.
21. PERSONAL RESPONSIBILITY
You are responsible for purchasing the style of trip that fits your desired comfort level and participating in activities that are suitable for your fitness level and capabilities. By making a booking, you acknowledge that Sisters and Suitcases’s trips are adventurous by nature and may involve a significant amount of personal risk.
22. COMPLAINTS AND CLAIMS
If you have any issues or questions during your trip, promptly notify us or your host or guide so that we can try to address them.
After completion of your trip, if you wish to make a claim, submit a complaint, or request reimbursement for any reason, you must do so by email within 30 days after the trip’s completion. Any and all supporting documentation to the claim or complaint must accompany the email. Any claim or complaint received by Sisters and Suitcases after this deadline will not be accepted or reviewed. 23. WI-FI
Wi-Fi connectivity may or may not be available during the trip. If available, it may be delayed, slowed, or otherwise interrupted. Sisters and Suitcases has no obligation to provide travelers with Wi-Fi connectivity during the trip.
24. Privacy Policy
By using the Sisters and Suitcases website and booking a trip with Sisters and Suitcases , you consent to Sisters and Suitcases use of your personal information. You acknowledge and agree that by purchasing a trip with Sisters and Suitcases , you consent to Sisters and Suitcases transmitting your personal information to our third-party suppliers, as necessary. You acknowledge that you have reviewed and agreed with the Sisters and Suitcases privacy policy. The policy can be found on our website at www.sistersandsuitcases.com
25. COPYRIGHT
Sisters and Suitcases is a service mark owned and registered in the U.S. Patent and Trademark Office. Sisters and Suitcases names, trademarks, service marks, logos, materials, and information shall not be used, reproduced, transmitted or distributed in any way, except with the express written consent of Sisters and Suitcases.
26. SEVERABILITY
In the event that any term or condition contained in these Terms is held to be unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining terms and conditions in these Terms to survive and continue as binding.
27. ENTIRE AGREEMENT
This is the entire agreement between Sisters and Suitcases and you as to any and all bookings, reservations, Experiences, trips, or transactions made with Sisters and Suitcases, and constitutes a binding agreement. You agree that there are no verbal or written representations, warranties, collateral agreements, or terms or conditions other than as expressed in these Terms.
28. APPLICABLE LAW AND CHOICE OF FORUM
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Arkansas without regard to applicable conflict of law provisions.

[2] Our lawyers tell us that “People” means our officers, directors, contractors, agents, employees, and any related, affiliated, associated, or otherwise connected corporations, partnerships, or other entities and all of their respective officers, directors, contractors, agents, employees, and any successors and assigns. We think that about does it.
PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP WITH SISTERS AND SUITCASES. THIS IS A LEGALLY BINDING AGREEMENT
The following terms and conditions apply to any trip or service (hereinafter referred to as “Product”) booked with Sisters and Suitcases (hereinafter referred to as “Company” “SAS” “our” “us”). By booking a trip with Sisters and Suitcases you (hereinafter referred to as, “Client(s)” “guest” “customer” “you” “your” or “traveler(s)” “experiencer”) acknowledge that you (i) are 21 years of age or older, (ii) understand and accept these terms and conditions (the “Terms and Conditions”) and (iii) are entering into a contractual relationship with Sisters and Suitcases.
Sisters and Suitcases travel itineraries (“Experiences”) are governed by the following Terms & Conditions (“Terms”). By booking an Experience and placing a deposit, you acknowledge and agree to these Terms.
Client agrees to release, indemnify, and hold harmless Sisters and Suitcases, its officers, directors, employees, contractors, vendors, travel guides, assignees, transferees, agents, and any other third parties acting on Sisters and Suitcases behalf against any and all expenses, losses, damages, accidents, injuries, claims, or deaths resulting in whole or in part, either directly or indirectly, from any aspect of travel and/or activities facilitated by Sisters and Suitcases. The Client further agrees that in no event and under no circumstances shall Sisters and Suitcases, nor its officers, directors, employees, vendors, guides, contractors, assignees, transferees, agents, and other third parties acting on the Company's behalf bear any total or aggregate liability (either jointly or severally) under Agreement that exceeds the amount of total fees paid by Client to Sisters and Suitcases for the particular trip in question.
The Client agrees to abide by all applicable domestic and international laws and regulations in the countries of travel and residency, regardless of length of time in said countries. If questioning, apprehension/arrest, detainment, punishment, or incarceration by lawful authorities occurs, Sisters and Suitcases shall not be responsible or liable, either legally, financially or otherwise, for Client actions or release.
1. RELEASE & ASSUMPTION OF RISK
We want you to know that there are some unavoidable risks associated with travel. We pride ourselves on the places we visit, our partners, and the Experiences we’ve created for you. But, you recognize that international travel may be unpredictable, and that our responsibilities are limited as discussed in these Terms.
Experiences take place in destinations outside of the United States. Although we scout each location; partner with awesome, knowledgeable partners; and take appropriate care in curating each Experience; we cannot guarantee any less risk than you might experience on your own. That means that, while we cannot guarantee your safety or your belongings, we promise to be upfront with you about where we’re planning on going and who we partner with. And, we promise to be available in a meaningful way should you need us. But, we expect and you agree that you will use proper care and be responsible for your well-being.
In booking an Experience and paying a deposit, you acknowledge that Experiences may:
- Involve risks, travel has some inherent danger;
- Involve places where housing, transport, safety, hygiene, cleanliness, medical facilities, telecommunications and infrastructure development may not meet your expectations at home;
- Include various activities, risks, and hazards, including form of travel, living conditions and foods, lodging, exploration of unfamiliar and/or foreign locations, cultural interactions and close-quarter conditions, medical risks, limited medical care and support, differing weather conditions and altitudes, various climates and environments, and other such risks;
- Take place in locations with higher rates of minor and/or violent crime than you have experienced before.
These Terms are a release and assumption of risk for you, your family or heirs, and any executors and administrators. The Terms are in addition to any additional releases, waivers, limitations of liability, or assumptions of risk that you may sign.
2. INSURANCE
It is mandatory that all Sisters and Suitcases travelers provide proof of current travel insurance before the trip begins. Travel insurance must cover personal injury, medical treatment, repatriation, and evacuation expenses, including helicopter rescue and air ambulance internationally. It is recommended that travel insurance also address personal property and trip cancellation coverage.
Trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses should a Sisters and Suitcases trip be canceled, postponed, interrupted, rescheduled, for any reason, whether voluntarily by you or as a result of Sisters and Suitcases’s actions. You are responsible for understanding the specifics of your travel insurance policy, ensuring that your policy covers all optional and included activities listed in the trip itinerary, and ensuring that there are no exclusion clauses (e.g., air delays due to mechanical issues) that would limit the coverage that you might reasonably need. If you have current health insurance coverage, check your insurance policy to see if it provides the coverage described above while traveling outside your country. It is your responsibility to verify your insurance policy details with your insurance provider to ensure Sisters and Suitcases’s requirements are satisfied.
You agree to assume all costs of medical care and transportation that is provided to you, and any minors traveling with you, during the trip. Please note that most companies offering travel insurance require the policy to be purchased within 14 days of the initial trip deposit or payment to any service provider in order to cover pre-existing conditions or to provide for “cancel for any reason” coverage.
3. HEALTH & MEDICAL
Medical care is different around the world. Sometimes, getting prompt attention abroad is more challenging than it may be at your home. We will do our best to assist in the event of any medical issue, but we are relying on you to let us know of potential issues and, should you have an issue, you agree that we are not responsible. Because of the costs of medical care, we require all of our travelers to obtain travel medical insurance.
Experiences take place in countries outside of the United States. Medical care and access to medical care may be different from what you are accustomed to. If you have any conditions or disabilities that we should be informed of, please let us know in advance so that we can help you obtain appropriate accommodations or take appropriate steps in case of need.
In booking an Experience, you acknowledge that Experiences may:
- Occur in remote locations, isolated or removed from medical care facilities, or otherwise lacking access to medical care.
- Occur in places with different medical facilities and standards of care from those you are accustomed to, Sisters and Suitcases makes no representations or warranties relating to any necessary medical facilities or standards of care.
Some of our experiences may require a certain level of fitness. In booking an experience and placing a deposit, you state that you:
- are sufficiently healthy to participate in the Experience;
- have not been informed by any medical professional that you should not travel or participate in activities like those on the Experience;
- Know of no physical or mental condition that would create a hazard for you or others, or affect other people’s enjoyment of the trip.
Sisters and Suitcases reserves the right to refuse or cancel any booking in the event of a medical condition that would make your participation a hazard for you or others, or for any other legal reason.
Sisters and Suitcases strongly recommends that you check with the U.S. Centers for Disease Control and Prevention, or similar entity in your country, for up-to-date, destination-specific information related to food and water safety, infectious diseases, and other concerns. At your own cost and expense, you will meet with your doctor at least 8 weeks prior to your trip departure and obtain any and all vaccinations, inoculations, or prescribed medications as directed by your doctor and/or travel clinic for the areas visited, and provide written documentation thereof upon request and as needed for travel documentation.
Our suppliers reserve the right to conduct health screenings (e.g., temperature checks, questionnaires, and checks for observable signs and symptoms) and refuse travel to participants deemed symptomatic or likely symptomatic. If necessary, suppliers and/or government or health authorities also reserve the right to quarantine travelers with symptoms of infectious diseases aboard confined modes of transport such as ships, trains, etc.
Sisters and Suitcases does not tolerate drug use of any kind during our trips and strongly encourages responsible alcohol consumption. This policy is in place for your safety and those traveling with you. Sisters and Suitcases reserves the right, at your sole expense, to deny participation in an activity or in the remainder of any trip itinerary if you illegally use drugs, alcohol or other banned substances during a trip. We want you to have fun and encourage you to take advantage of the local culture, but Sisters and Suitcases emphasizes safety as a top priority.
4. Deposits, Payments, Refunds and Cancellations
Prompt payment is important not only to us, but also to our partners. Timely payment by our travelers allows us to reserve the best lodgings and ensure our partners are available for each Experience. Full payment must be made at least sixty days before your Experience’s start date.
Bookings may be made through our online booking system or through an authorized travel agent. You are required to pay a non-refundable deposit or first payment for your booking to be confirmed, non-refundable monthly payments if a payment plan option is selected and a non-refundable final payment of the entire balance due no later than 60 days before the trip departure date, unless otherwise stated in the Special Conditions or on the itinerary page on our website for a specific trip. For bookings made 60 days or sooner before the trip departure date, the entire trip cost must be paid when the booking is confirmed and is non-refundable. Review the applicable deposit and payment schedules carefully. Note that a booking is not accepted and there is no contract between us until we confirm your booking in writing.
The following are specifically excluded from the trip rates and are the sole responsibility of each Traveler: Airfare; travel insurance; costs of obtaining passports; visas; excess baggage charges; gratuity/tips; items of purely personal nature; such as drinks; laundry; Covid-related expenses (whether mandatory or voluntary) such as testing, quarantine, etc., communication (calls, faxes, emails etc.); international airport departure tax (to be paid in US dollars or acceptable foreign currencies); excursions or deviations from any trip itinerary. We will not be responsible or liable for deposits, payments, policies or penalties for other services not included, such as airline tickets, separate hotel reservations, or other items handled by you and not through us.
Credit Card Payment/Processing: Sisters and Suitcases uses a third-party credit card processing company to provide clients with a convenient way of submitting payment. Sisters and Suitcases is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of Products and will not refund or return any fees charged by such third parties in connection with payments made by Clients to Sisters and Suitcases.
Credit/Debit Card Chargeback Policy & Payment Disputes. We work hard to make our customers happy. If you are not pleased with our services for any reason, you agree not to file a chargeback with your credit or debit card company either directly or through someone else, including a travel agent, before you have given us an opportunity to address the matter. You agree to work with us and any travel agent acting on your behalf in good faith to resolve your dispute and acknowledge that chargebacks are not an appropriate way to avoid our cancellation and refund policies.
Client agrees to not file a payment dispute or chargeback through their bank/financial institution and to instead utilize travel insurance in the event that she can no longer attend the scheduled trip.
Client agrees to not file a chargeback in violation of Sisters and Suitcases Refund Policy. In the event that a chargeback is requested and/or processed, Client agrees to repay Sisters and Suitcases for the full amount and be responsible for any fees incurred in recouping payment, including attorney’s fees, time, cost and expenses in rebutting the chargeback and pay any damages we suffer as a result of your chargeback dispute.
Late Payment: Failure to make a payment within three days of the agreed upon due date is a breach of contract and will result in a late fee of $100.00.. If payment has not been submitted within seven (7) days of the due date, Sisters and Suitcases reserves the right to cancel Client’s booking and & retain all paid funds.
If Client fails to submit payment in full by 60 days prior to the date of arrival unless otherwise stated in the Special Conditions or on the itinerary page on our website for a specific trip, Sisters and Suitcases reserves the right to cancel booking and retain 100% of funds paid.
Cancellations by You: In the event that a Client attempts to cancel after 14 days of the initial deposit or payment Sisters and Suitcases reserves the right to retain 100% of all paid funds. The Client agrees to not file a dispute or chargeback through their bank and to instead utilize their travel insurance in the event the Client can no longer attend the scheduled trip/event.
Any cancellation of a booking and/or a Product by a Client must be delivered to Sisters and Suitcases in writing by email and be acknowledged by Sisters and Suitcases in writing. Email your cancellation request to [email protected] with your invoice number(s), full name, date of travel and destination. If you do not receive an acknowledgement within 48 hours, please call (501) 960-1226 to ensure your information was received.
Products are NON-REFUNDABLE and NON-TRANSFERABLE between persons. It is highly recommended that Sisters and Suitcases clients PURCHASE trip cancellation coverage. Trip cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your Sisters and Suitcases trip for any reason, whether voluntarily or as a result of Sisters and Suitcase's actions.
Sisters and Suitcases is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the canceled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. To cancel services booked through third party vendors, please contact the applicable vendor.
Cancellation or Changes by Sisters and Suitcases and Flexibility: We reserve the right to cancel, alter or modify any trip without prior notice for any reason, including but not limited to for the safety and/or comfort of clients and for circumstances of Force Majeure, which is defined in this agreement below. This includes the right to replace or substitute guides and accommodations in the trip materials, modify the order in which places are to be visited, reschedule, postpone or delay your trip, and make other changes to the itinerary. You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.
Sisters and Suitcases shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder as a result of any actions that it takes or does not take under this section and under this Agreement.
If we must cancel a trip due to insufficient enrollment for reasons not due to Force Majeure, all trip members will be notified a minimum of 60 days before the trip departs and will have the option to receive a refund of payments made to Sisters and Suitcases less any unrecoverable costs incurred by Sisters and Suitcases or to transfer to a comparably priced replacement trip without penalty.
Any changes may require a supplemental payment from you or result in a partial or full refund. A supplemental payment is a rare situation; however, such a payment may arise due to unexpected events (e.g., increase in government fees). A refund under this section will constitute full settlement of claims you may have arising out of our cancellation.
If Sisters and Suitcases is forced to reschedule, substantially alter, postpone, or cancel your trip for any reason that is completely within its control, whether before or during your trip, we will let you know as soon as possible. In these circumstances, we may offer one or more of the following options within our discretion:
i. Accept Sisters and Suitcases offer of a comparable replacement trip (offered atSisters and Suitcases’s sole discretion and subject to availability),
ii. Receive a refund of all monies paid to Sisters and Suitcases less our Trip Planning Fee of $495, any unrecoverable costs, including but not limited to deposits that we have made to our suppliers and any other out-of-pocket costs that we have incurred in organizing your trip ; or
iii. Any other option that we in our sole discretion believe is a reasonable option.
When accepting an offer for a replacement trip :
i.If the cost is lower than the price of your original trip, you will receive a refund for the difference in cost.
ii. If the cost of the replacement trip is equivalent or higher than your original trip, you will be responsible for the price difference between your original trip and the replacement trip.
If we expressly cancel your trip (versus altering, modifying, postponing, or rescheduling it), we may use reasonable endeavors to reimburse you for any payments that you have made reduced by 1) any and all non-refundable deposits and cancellation fees that we have paid to suppliers and other third parties to provide components of your tour (in many cases it is not possible to obtain refunds from suppliers once we have forwarded deposits for your tour to them), and 2)Sisters and Suitcases $495 per person Trip Planning Fee. In great part for reasons of this nature, we strongly recommend you obtain travel insurance as explained elsewhere in this agreement. Note that if we alter, modify, postpone, or reschedule your tour or offer you a travel credit, such action does not constitute a “cancellation” of your tour by us.
Reinstatement of Reservation: If your travel reservations have been canceled by Sisters and Suitcases, and you notify us within 14 days that you want to reinstate your reservations, a service reinstatement fee of $200 for international and domestic Sisters and Suitcases Experiences will be added to your invoice and must be paid in advance in order to apply for reconfirmation of services.
Trip Planning Fee: All trip prices include a non-refundable $495.00 Trip Planning Fee per person. Any refunds that we provide to you for any reason will be less than Trip Planning Fee and any other non-recoverable costs, including any monies that we have advanced to our suppliers.
Form of Payment: All payments must be made by credit card. Prices are in US dollars, and all payments must be made in US dollars.
Cancellation Process: To cancel your booking, you must send a written notice to us by email at [email protected]. Cancellation fees will be applied per person according to the schedule set forth in this section, based on the date we receive your written notification, not when you send the email.
5. CHANGES BY YOU PRIOR TO DEPARTURE
Change requests to our itineraries can be very disruptive. If you request to change your trip dates or alter your itinerary after we confirm your booking but before your trip’s departure date, we will consider whether we can reasonably accommodate your request without any disruption to the trip or trip economics. If we are able to make such changes, a change fee may be applied. (There is no change fee for transfers to replacement trips described in the preceding section.) The type and scope of change dictates the amount of the change fee and such fees can be substantial. Our outside suppliers, including hotels, often impose additional fees or penalties for changes and cancellations. Substantial change requests by you, such as for example a change of tour dates, will result in recalculation of your original tour price. Change requests must be made in writing.
It is in our sole discretion whether to accept a change request.
If you decide not to participate in a Program, whether due to governmental warnings or advisories, fear of travel, fear of illness or for any other reason, will be deemed a cancellation by you. In the event you have to cancel the Program because you have contracted Covid-19 (which includes all virus variants directly related to the SARS-COV-2 novel coronavirus, hereinafter referred to as “Covid-19”), test positive for Covid-19, or have been in close proximity to someone who tested positive for Covid-19 fourteen days before trip’s departure prevents you from participating in the Program, Sisters and Suitcases will make best efforts to enable you to reschedule your trip to a later date; however, in the event you are unable to reschedule your trip under such circumstances, the cancellation policy set forth herein will still apply.
6. ALTERATION OR CANCELLATION BY YOU AFTER COMMENCEMENT OF TRAVEL
Change or Cancellation Request
Change requests to our itineraries must be submitted in writing and may result in significant fee increases. To change your booking, you must send a written notice to us by email at [email protected]. For any changes that we are able to accept, change fees will be applied per person according to the terms set forth in these Program Terms & Conditions, based on the date we receive your written notification, not when you send the email.
Upon receipt of your change request, Sisters and Suitcases will forward any alteration that you request after your Program has commenced to our independent suppliers. You will be liable for any cancellation charges and/or change fees that may be imposed for the booking of revised arrangements and for all costs associated with such arrangements. You hereby acknowledge and agree that it is within Sisters and Suitcases sole discretion whether to accept a change request.
You acknowledge and agree that any changes to your booking or cancellation of services at any time, before or during the trip, by you may result in the loss of all monies collected from you and as otherwise described in this agreement. For this reason, we strongly recommend you have comprehensive travel insurance that includes trip cancellation/interruption coverage to help protect your financial investment in the trip. See Section 1 above regarding mandatory insurance requirements.
7. Unused Services
General Reasons: There will be no refund for unused services or unused portion of the trip, early departures, late arrivals, involuntary Program removal, or missed days of your itinerary for any reason.
Unused Portion of Trip (no refunds): There will be no refund for unused services, early departures, late arrivals, or missed days of your itinerary for any reason. There will be no refund once the tour has commenced. Your decision not to participate in the tour due to governmental warnings or advisories, fear of travel, or the like will be deemed a cancellation. Note that if a disruption caused by Covid-19 prevents you from being able to take your trip, we will offer as much flexibility as we can to enable you to reschedule your trip to a later date, although our cancellation policy will still apply should you cancel your trip. Our level of flexibility will be impacted by our suppliers’ policies and practices, which we do not control.
No refunds will be provided to you for any unused portion of your tour, including but not limited to if you are quarantined, a government refuses exit/reentry, or a supplier refuses services if you exhibit symptoms of or test positive for infectious disease. Further, we will not have any liability to you, owe you a refund, or owe you any compensation for loss, damage or injury or anything else if you are infected with an illness, disease or sickness during your tour, or if a third party refuses services (e.g., lodging or transport) if you show symptoms of or test positive for infectious disease. For example, we will not be liable to you if are infected with a virus such as coronavirus at a hotel that we book for you, if you are refused service at a hotel if you show symptoms of a communicable illness such as a cough or fever, if you are unable to board a plane to your destination or return home from your destination because you show symptoms of an illness, you are required to self-quarantine, and so on.
No refunds will be provided for any unused portion of a trip once the trip begins, including but not limited to if you leave a trip for any reason, miss the trip’s departure date or an activity, transportation, last minute changes or have to be removed from a trip. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we highly recommend that you purchase trip cancellation and interruption insurance.
Due to Illness: No refunds will be provided to you for any unused portion of your trip if you are quarantined or a supplier refuses services if you exhibit symptoms of or test positive for an infectious disease. Further, we will not have any liability to you, owe you a refund, or owe you any compensation for loss, damage or injury or anything else if you are infected with an illness, disease or sickness during the Program, or if a third party refuses services (e.g., lodging or transport) if you show symptoms of or test positive for an infectious disease. Solely by way of example and not intended to be exhaustive, we will not be liable to you: if are infected with a virus such as coronavirus at a hotel that we book for you; if you are refused service at a hotel if you show symptoms of a communicable illness such as a cough or fever; if you are unable to board a plane to your destination or return home from your destination because you show symptoms of an illness; or, you are required to self-quarantine, and so on.
8. DENIAL OF PARTICIPATION
Sisters and Suitcases reserves the right to deny participation in the trip to any Traveler that Sisters and Suitcases, in its sole discretion, judges to be incapable of meeting the rigors and requirements of the trip activities, violates these terms including our Code of Conduct, or whose actions or deportment it judges unsuitable for group travel. During the trip, Sisters and Suitcases has the right in its sole discretion to remove anyone who it determines to detract from others’ enjoyment of the trip. The decision of the guide, host or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. Any costs resulting from being removed from a trip or being declined participation in a trip is at your expense.
9. FORCE MAJEURE
Force Majeure. Sisters and Suitcases will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, typhoon, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, pandemic, epidemic, diseases and viruses that are known, unknown or novel such as coronavirus/Covid-19 (including any spread thereof), foodborne, airborne, and communicable illnesses and disease, government intervention of any kind that affect domestic and/or international travel, government restrictions or warnings, diplomatic or health organization (e.g., World Health Organization) warnings, border closings, weather conditions, and unforeseen circumstances.
In the uncommon situation where Force Majeure prevents, significantly hinders, or makes it impossible for us or our suppliers to provide the services including but not limited to your tour, we and/or our suppliers shall be entitled to, in our sole and absolute discretion, take one or more of the following steps: cancel, alter, modify, postpone, or reschedule any tour itinerary or arrangement, including tour dates and the entire tour itself. You understand and agree that we will not be able to pay you any compensation, costs, or expenses you incur as a result of Force Majeure. We regret that no refunds will be provided if we take any of the preceding actions due to Force Majeure, unless and to the extent we are able to obtain any refunds from our suppliers. Any refund under this section will be less than our non-refundable $495.00 trip planning fee per person (“Trip Planning Fee”). Our administration costs in planning your trip are not refundable because of the work involved in planning, booking and management of your trip itinerary from the moment the trip is booked. This “Trip Planning Fee” is a cost that we cannot recuperate, again because of the time and materials already invested in the trip. Please note that we are not obligated to seek refunds from suppliers, and in many instances it is not possible to obtain refunds from suppliers once we have forwarded deposits for your tour to them. Any refund under this section will be less the $495.00 Trip Planning Fee you have paid, and any and all non-refundable deposits and cancellation fees that we have paid to suppliers and other third parties to provide components of your tour. This policy is based on the fact that suppliers, who are typically located outside the United States, are not obligated to return non-refundable deposits or waive their cancellation fees in the case of Force Majeure. For reasons of this nature, we strongly recommend you obtain travel insurance. If you choose to cancel your tour if we invoke Force Majeure, our standard cancellation penalties (see above section titled “Cancellation By You and Unused Services”) will apply unless we expressly state otherwise.
If Sisters and Suitcases is affected by Force Majeure, it, if practicable, will notify you of the nature and extent thereof.
10. SUPPLIERS’ CONDITIONS
Sisters and Suitcases sometimes works with other companies in crafting Experiences. Although we work hard to ensure a safe journey for our travelers, we cannot control those companies we work with and cannot be responsible for their actions.
Sisters and Suitcases acts as an agent for transport companies, hotels and other partners and contractors (“Suppliers”) and is not responsible for any injury, damage, loss, delay or irregularity that may occur when using the products, services, or accommodations of a Supplier, or due to the negligence, recklessness, omission, oversight, inaction, or other fault of a Supplier, including, but not limited to, any defect in a vehicle or any other form of conveying a traveler, acts of God, detention, delays or expenses arising from quarantine, strike, riots, theft, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle or any other form of transport, or in any hotel or guest house, hostel, or other form of accommodation.
The quality of the products, services, and accommodations organized by Sisters and Suitcases are not within the control of Sisters and Suitcases, and the quality of such products, services, and accommodations may be compromised by local conditions. You therefore release Sisters and Suitcases from all claims and causes of action arising from any damage, loss of enjoyment, inconvenience, or injuries related to the quality of such products, accommodations, and services.
Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage. You will be bound by these conditions or conditions. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other Supplier, and they are often also subject to various international conventions. Sisters and Suitcases’ own liability is limited to and shall not exceed that of its Suppliers. You agree that, if you recover for any damages from the Suppliers, you will not seek any recovery for the same damages from Sisters and Suitcases.
11. OPTIONAL ACTIVITIES/FLEXIBILITY
During any Sisters and Suitcases Experiences, there may be opportunities to participate in activities or local events, which are not included in Sisters and Suitcases’s packaged experience. Sisters and Suitcases makes no representations about the safety or quality of these activities and events, or the standard of the independent operator running it. Activities may include, but are not limited to, vehicle/boat/aircraft trips, walking or guided trips, surfing, fishing, hiking, swimming, zip lining, and parasailing. Events may include, but are not limited to, local festivals, concerts, and organized events. You understand and agree that any assistance given by Sisters and Suitcases trip leader or staff to help arrange these optional activities is done in good faith and without any representations or warranties of any kind. Sisters and Suitcases does not sponsor or endorse these activities or events, nor can Sisters and Suitcases be held liable for any injury or illness resulting from your participation. If you decide to participate in these events, you do so voluntarily and should take precautions to ensure your own safety and you will arrange for payment directly with the supplier or independent operators of such activities, events or services
FLEXIBILITY: The Client acknowledges by booking a Product and/or agreeing to travel with Sisters and Suitcases that the nature of this type of travel requires considerable flexibility and acknowledges that they will permit reasonable alterations to the Product and/or itinerary by Sisters and Suitcases. The Client acknowledges their understanding that the route, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the Product will be operated, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Sisters and Suitcases.
12. CLIENT RESPONSIBILITY
The Client acknowledges that depending on the nature of the Product booked, or the location(s) in which such Product is to operate, there may be a significant degree of personal risk involved in travel on the Product. There are dangers inherent to adventure travel generally and Client acknowledges they have considered such risk to health and safety and are willing to assume it, by confirming their booking of such Product. The Client acknowledges she or he has considered the potential risks, dangers and challenges in light of their own personal capabilities and needs, and expressly assumes the risks attendant to travel under such conditions. The Client acknowledges and agrees that Sisters and Suitcases is not responsible for providing information or guidance to the Client with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where Products are operated, and Sisters and Suitcases strongly encourages that Clients locate or make contact with his/her local embassy or consulate in each destination prior to departure on any Sisters and Suitcases Experience.
13. PRE-DEPARTURE DOCUMENTATION
There are a number of documents you will need for each Experience. Some of these are legal requirements, and others are required by Sisters and Suitcases. We can help identify the ones you may need, but ultimately the responsibility for gathering them is yours.
You must have a valid passport and, depending on your place of departure and the destination, a visa, permits, certificates, and proof of vaccination(s). (You will also ensure that your passport will remain valid through all relevant times you are traveling with us.) These requirements are your responsibility. Any information or advice given by Sisters and Suitcases regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory and provided as a courtesy. Sisters and Suitcases is not responsible for any errors or omissions as to any such information provided. Sisters and Suitcases require proof of insurance at least 45 days before the Start Date or one week after the date of booking (whichever is latest). We will work with you to help you identify these documents, but failure to provide these documents may result in cancellation of your booking without refund.
14. PASSPORTS AND VISAS
You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire trip. Valid passports are required for travel to most destinations. Please check with the appropriate consulate or embassy for the latest entry requirements. You assume complete and full responsibility for, and hereby release Sisters and Suitcases from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations. Any information provided to you is merely provided as a courtesy and it is your sole responsibility to ensure you have met all travel requirements for each destination in your itinerary.
Sisters and Suitcases is not responsible for delays, changes, or cancellation costs due to incorrect, incomplete or expired traveler documents. In the event that you must cancel, delay or reschedule your trip due to expired or missing travel documentation, you are responsible for all associated costs to rectify the situation. If you are unable to join your trip, you will not be reimbursed or refunded any amounts as per the cancellation terms listed in this document. We recommend that U.S. citizens register for the U.S. government’s Smart Traveler Enrollment Program, a free service, at https://step.state.gov/step/.
15. BAGGAGE
You are allowed to bring one piece of baggage weighing up to 50 lbs. (23 kg) and one additional medium/small-sized “day pack” on the trip. If you need to bring additional baggage, you are responsible for requesting approval from Sisters and Suitcases before your trip begins. Unless you receive such written approval, your request to bring additional baggage is deemed denied. Sisters and Suitcases is not responsible for and you are solely responsible for securing or protecting your baggage or belongings at any time during any trip.
16. PHOTOGRAPHY AND IMAGE RELEASE
We may hire a photographer to capture special moments from the Experience. You agree that we have your permission to use any such moments in our marketing material or for other related commercial uses.
Sisters and Suitcases may hire a photographer or videographer for the Experience. The Photographer will own the rights to any images, photos, and videos (“Content”) that s/he takes or creates during the Experience. Because the Photographer will own the rights to all Content, you cannot sell any Content or otherwise use it commercially. You may use Content for personal use only. If you post Content, including but not limited to a website or social media, you agree to credit the Photographer by name and a copyright notation.
You agree that Sisters and Suitcases and its agents, suppliers, vendors, and similar third-parties, including Photographers, have a worldwide, royalty-free, perpetual license to use, re-use, distribute, display, create derivative works of, and reproduce any images, photos, or videos (whether directly or through a photo sharing service) in any medium, including but not limited to print, electronic media, or Internet, free of charge and without right to inspection, for any purpose, including to promote and publicize Sisters and Suitcases products and services worldwide.
You also acknowledge and agree that Sisters and Suitcases or other parties, including but not limited to the Photographer and other participants in Your Experience, may during Your Experience take or create images, photos, and videos in any format that contain or feature you. These images may contain your name, likeness, identity, photographic image, videographic image or oral or recorded statements. You agree that Sisters and Suitcases may use these materials for any purpose, including to promote and publicize Sisters and Suitcases products and services, and hereby grant Sisters and Suitcases a perpetual, royalty-free, worldwide, irrevocable license to use such images without prior inspection.
17. LIMITS ON RESPONSIBILITY
Costs associated with travel are your responsibility. We can give you an idea of what some of those costs may be, but we cannot pay them for you.
At no point, and under no circumstance, is Sisters and Suitcase responsible for payments or costs relating to external services such as flights, accommodations, services, car service, or any other part of travel that was booked and paid for externally to Sisters and Suitcases. You are responsible for booking, paying, and arranging for travel to and from the Experience. If Sisters and Suitcases cancels or changes the Experience, it may cause you to incur some change fees or other related costs. Travel insurance may assist you in avoiding any such fees for trip cancellation, interruption, and curtailment.
18. CULTURAL DIFFERENCES, DRUG, & ALCOHOL POLICY
Countries we travel to may have different laws about drinking and drug use than your home country. But, for the sake of our travelers and partners, we require that you act safely and responsibly. Should we determine in our sole discretion that you are endangering yourself or others, we reserve the right to terminate your Experience with no refund.
You acknowledge and understand that traveling abroad may expose you to unique and different situations. These differences may involve cultural and social interactions, such as food, drink, attire, and local laws. While Sisters and Suitcases strives to provide guidance regarding these differences, it is your responsibility to research such differences and act responsibly while traveling.
Sisters and Suitcases does not tolerate drug use of any kind during Experiences and, for our partners and other travelers, requires responsible alcohol consumption. You will comply with the laws of all countries visited. Failure to abide by this provision may result in immediate termination of your Experience by Sisters and Suitcases without a refund or other liability by Sisters and Suitcases.
This policy is for the safety of you, your fellow travelers, and our partners. Sisters and Suitcases wants you to have fun and encourages involvement in local culture, but safety is our top priority.
19. AUTHORITY DURING EXPERIENCES
Sisters and Suitcases has curated each Experience. We are familiar with the partners and the locations. It is of utmost importance that you comply with our requests.
You agree to abide by the authority of the trip leader or other Sisters and Suitcases representatives at all times. Should you fail to do so, or, in the opinion of the trip leader or other Sisters and Suitcases guests, endanger, distress or annoy others, we may immediately terminate your Experience without a refund or other liability.
20. TRAVEL ADVISORIES AND WARNINGS
You must conduct your own research and become informed about the destinations in your trip itinerary, including knowledge about any travel advisories and warnings issued by government authorities in your country. In the U.S., you must consult the U.S. State Department’s website at www.travel.state.gov or contact them by phone at the number specified on their website. You are responsible for protecting your own well-being and personal property before, during, and after your Sisters and Suitcases trip. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.
21. PERSONAL RESPONSIBILITY
You are responsible for purchasing the style of trip that fits your desired comfort level and participating in activities that are suitable for your fitness level and capabilities. By making a booking, you acknowledge that Sisters and Suitcases’s trips are adventurous by nature and may involve a significant amount of personal risk.
22. COMPLAINTS AND CLAIMS
If you have any issues or questions during your trip, promptly notify us or your host or guide so that we can try to address them.
After completion of your trip, if you wish to make a claim, submit a complaint, or request reimbursement for any reason, you must do so by email within 30 days after the trip’s completion. Any and all supporting documentation to the claim or complaint must accompany the email. Any claim or complaint received by Sisters and Suitcases after this deadline will not be accepted or reviewed. 23. WI-FI
Wi-Fi connectivity may or may not be available during the trip. If available, it may be delayed, slowed, or otherwise interrupted. Sisters and Suitcases has no obligation to provide travelers with Wi-Fi connectivity during the trip.
24. Privacy Policy
By using the Sisters and Suitcases website and booking a trip with Sisters and Suitcases , you consent to Sisters and Suitcases use of your personal information. You acknowledge and agree that by purchasing a trip with Sisters and Suitcases , you consent to Sisters and Suitcases transmitting your personal information to our third-party suppliers, as necessary. You acknowledge that you have reviewed and agreed with the Sisters and Suitcases privacy policy. The policy can be found on our website at www.sistersandsuitcases.com
25. COPYRIGHT
Sisters and Suitcases is a service mark owned and registered in the U.S. Patent and Trademark Office. Sisters and Suitcases names, trademarks, service marks, logos, materials, and information shall not be used, reproduced, transmitted or distributed in any way, except with the express written consent of Sisters and Suitcases.
26. SEVERABILITY
In the event that any term or condition contained in these Terms is held to be unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining terms and conditions in these Terms to survive and continue as binding.
27. ENTIRE AGREEMENT
This is the entire agreement between Sisters and Suitcases and you as to any and all bookings, reservations, Experiences, trips, or transactions made with Sisters and Suitcases, and constitutes a binding agreement. You agree that there are no verbal or written representations, warranties, collateral agreements, or terms or conditions other than as expressed in these Terms.
28. APPLICABLE LAW AND CHOICE OF FORUM
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Arkansas without regard to applicable conflict of law provisions.

[2] Our lawyers tell us that “People” means our officers, directors, contractors, agents, employees, and any related, affiliated, associated, or otherwise connected corporations, partnerships, or other entities and all of their respective officers, directors, contractors, agents, employees, and any successors and assigns. We think that about does it.
